The petitioner is an accused in connection with Supaul P.S. Case No.577 of 2020 registered on 13.06.2020 under Sections 302, 201/34 of the Indian Penal Code. The informant is the wife of the deceased and the FIR shows that she is also the eyewitness to the occurrence.

As per the prosecution story, the informant alleges that thinking that her husband is a Sorcerer, the petitioner's family wanted him to cure his son. When the deceased denied that he is a Sorcerer, it is alleged that he was verbally, abused taken away, tied to rope and firstly they tried to drown him in the Koshi river and lastly after pouring K. oil set him ablaze. Naturally, the victim lost his wife.

Considering the nature of crime that has been committed amongst others by the petitioner herein, this Court is
