JUSTICE ARVIND SRIVASTAVA ORAL ORDER 21-02-2018 Heard learned counsels for the petitioner and the State. Petitioner seeks bail in connection with Andhratharhi P.S. Case No. 100 of 2016 registered for the offence punishable under section 307 and other allied sections of the Indian Penal Code.
Petitioner has earlier moved this Court for grant of regular bail in Cr. Misc. No. 22653 of 2017 which was rejected by order dated 29.06.2017 (Annexure-1).
As per order dated 10.01.2018 a report was called for from the Court below with regard to the stage of the case, which has been received and is kept at Flag-A. Perusal of the report shows that there is no substantial progress in the case. Learned counsel appearing for the petitioner submits that
Patna High Court Cr.Misc. No.61207 of 2017(5) dt.21-02-2018 2/2 petitioner is in custody since 17.08.2016 and there is no progress in the case in the court below.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri Devesh Kumar, Judicial Magistrate, 1st Class, Jhanjharpur in connection with Andhratharhi P.S. Case No. 100 of 2016.
