The petitioner has preferred this application for grant of regular bail in a case registered under section 392 of the Indian Penal Code.

As per the prosecution case, three accused persons on the point of fire arm snatched the motorcycle of the informant.

It is submitted by learned counsel for the petitioner that the FIR was registered against three unknown. The name of the petitioner transpired in course of investigation, while allegedly some of the stolen parts were recovered from his shop. It is stated that the prosecution is relying on the confessional

A number of coaccused have been enlarged on bail namely Sonu Kumar vide order dated 28.1.2022 passed in Cr.Misc.no.39067 of 2021 and Deepak Kumar vide order dated 13.12.2021 passed in Cr.Misc. No.38133 of 2021. The petitioner is in custody since 8.1.2021 and has no criminal antecedent. Chargesheet has been submitted in the case.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner not having any criminal antecedent, having remained in custody for over 1 year and grant of bail to the above named two coaccused, the Court directs the petitioner to be enlarged on bail in connection with Town Hajipur P.S. Case no. 859 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Hajipur at Vaishali.
