The petitioner is apprehending arrest in a case registered for the offences punishable under sections 20 and 22 of the NDPS Act.

It is alleged that from the house of the petitioner 500 grams of ganja was recovered.

It is submitted by the learned counsel for the petitioner that since the wife of the petitioner is on litigating terms as she has filed a case under section 498A IPC hence she got the recovery made and the recovery has been made from the joint family house. The wife of the petitioner is a seizurelist witness and the quantity of recovery is less than small quantity as prescribed

Patna High Court Cr.Misc. No.57001 of 2015 (2) dt.17-12-2015 2/2 under the Act.

Considering the quantity of recovery, it is a case for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Special Case No. 20 of 2015 arising out of Rajiv Nagar P.S. Case No. 248 of 2015 pending in the court of learned Sessions Judge, Patna.

This application is disposed of with the aforesaid observation/direction.
