JUSTICE RAKESH KUMAR ORAL ORDER 24-11-2016 Heard Mr. Md. Naushaduzzoha , learned counsel for the petitioners and learned Additional Public Prosecutor . Four petitioners who are elder brother, mother -inlaw , wife of petitioner no. 1 and sister of the husband of the informant respectively have prayed for grant of anticipatory bail in Supaul Mahila P.S. Case No. 39 of 2016 registered for the offence under section 498A, 323, 504, 506/34 of the Indian Penal Code .
It was submitted by learned counsel for the petitioners that husband and informant are residing separately and as such there is no reason for committing any offence by the petitioners.
Patna High Court Cr.Misc. No.48192 of 2016 (2) dt.24-11-2016 2/2 He submits that informant had implicated entire family member of her husband in the present case. It has been accepted that there is allegation against husband of the informant. Keeping in view the fact that petitioners are in- laws of the informant as well as nature of accusation, in the event of their arrest or surrender within a period of six weeks from today, let the aforesaid four petitioner Md. Amanat, Tanjeela Khatoon, Nahida Praveen, Jamila Khatoon be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Supaul / concerned court in connection with Supaul Mahila P.S. Case No. 39 of 2016 subject to the conditions as contemplated under section 438(2) of the Code of Criminal Procedure (Rakesh Kumar, J) Praful/- U T
