====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 21-06-2021 Heard the parties in virtual Court.

Petitioner seeks bail in a case registered for the offences punishable under Sections 8,20(B)(ii)(b) of the Narcotic Drugs and Psychotropic Substance (N.D.P.S.) Act. Allegation is of recovery of 01 Kg of Charas from possession of the petitioner.

Submission is that the petitioner is in custody since 23.06.2019. He has got no criminal antecedent under N.D.P.S. Act.

In the past prayer for bail was refused on 19.03.2020, however, there is no chance of early conclusion of the trial due to Covid effect. Moreover, there is non-compliance of mandate of law in the matter of search and seizure.

Considering the submission aforesaid, let the

Patna High Court CR. MISC. No.801 of 2021(5) dt.21-06-2021 2/2 petitioner, above named, be released on bail on furnishing bail bond of Rs.50,000/- (Fifty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sathi Police Station Case No.75 of 2019 with following conditions: (a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
