JUSTICE RAVI RANJAN ORAL ORDER 19-09-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 272, 273, 120(B) of the Indian Penal Code and Sections 46(A), 51, 57, 63 of the Bihar Excise Amendment Act, 2016.
Allegedly, four cartons of imperial blue foreign liquor as well as five pouches of 200 ml. country made liquor were recovered from the poultry farm of Arvind Prasad. It is contended that the petitioner has been implicated only due to the reason that he happens to be the driver of the aforesaid Arvind Prasad, though there is no allegation in the First Information Report that either petitioner had brought the liquor or any liquor has been recovered from his possession. Having regard to the facts and circumstances of the case, let the petitioner, namely, Rohit Kumar @ Jackie be released on bail in the event of his arrest/surrender before the court below within a period of six weeks from today in connection with Nasriganj P.S. Case No. 121 of 2016, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-1st-cumAdditional Chief Judicial Magistrate, Bikramganj, Rohtas, subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
