JUSTICE ASHUTOSH KUMAR ORAL ORDER 13-09-2019 The petitioner seeks bail in connection with Sadar (Purnea) P.S. Case No. 72 of 2019, dated 06.02.2019, instituted for the offences under Sections 457, 380, 411 and 413 of the Indian Penal Code.

An attempt was made by the petitioner and one Md. Umar Ansari to enter the mobile peripherals shop of the informant. The petitioner is said to have been apprehended while coming out of the shop. No stolen article was found from the possession of the petitioner. Co-accused/Md. Umar

Patna High Court CR. MISC. No.44986 of 2019(3) dt.13-09-2019 2/2 Ansari, who too was apprehended along with the petitioner, has now been granted bail.

The petitioner is in custody since 07.02.2019. The petitioner has been granted bail in an earlier case in which he was found to be involved.

Considering the aforestated facts, the petitioner/Md. Istiyak is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with Sadar (Purnea) P.S. Case No. 72 of 2019. The application stands allowed.
