JUSTICE ASHUTOSH KUMAR ORAL ORDER 10-06-2021 Heard Mr. Sanjay Kumar, learned counsel for the petitioner and Mr. Patanjali Rishi, learned counsel for the informant. The State is represented by learned APP. The petitioner seeks bail in anticipation of his arrest in connection with Bikram P. S. Case No. 230 2020, instituted for the offences under Sections 147, 148, 149, 341, 323, 307, 504, 506 and 379 of the Indian Penal Code.

The accusation against the petitioner is that on his instigation the informant and his sons were assaulted.

The learned counsel for the petitioner has

The petitioner is an agnate of the informant and they are in opposite camps in the village because of the recent Mukhiya election. The injuries suffered by the victims are reported to be simple in nature.

Mr. Patanjali Rishi, learned advocate for the informant has submitted that the petitioner is the main person who instigated others to assault the informant and his sons and not satisfied with that, he has also been interfering in the process of investigation. This, it has been urged, dis-entitles the petitioner for grant of anticipatory bail.

Regard being had to the afore-stated facts, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on his

No.40166 of 2020(2) dt.10-06-2021 3/3 furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. VI, Danapur, in connection with Bikram P. S. Case No. 230 2020, subject to the conditions as laid down under Section 438

(2) Cr.P.C.

However, it is cautioned that in case the petitioner interferes with the investigation process and if this fact is brought to the notice of the court below, the bail granted to the petitioner would render liable to be cancelled.
