JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-01-2016 Heard learned counsels for the petitioner and the State. The petitioners being the parents of the husband of the daughter of the informant are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 379, 498A, 504 and 506/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
The basic accusation is of torturing the daughter of the informant after three years of the marriage for non-fulfillment of the dowry demand. It is further alleged that due to torture, the pregnancy of the daughter of the informant got terminated. It is submitted by learned counsel for the petitioners that the accusation is omnibus and general against the petitioners and the thrust of accusation is against the husband of the daughter of the informant when petitioners claim to be separate from the
Patna High Court Cr.Misc. No.58586 of 2015 (2) dt.05-01-2016 2/2 husband of the daughter of the informant.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Supaul in connection with Marauna P.S. Case No. 127 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
