JUSTICE PURNENDU SINGH ORAL JUDGMENT Date : 04-09-2023 Heard Mr. Rajiv Ranjan Kumar Pandey, learned counsel appearing on behalf of the petitioner, Mrs. Puspanjali Sharma, learned counsel appearing on behalf of the State and Mr. Arun Kumar Arun, learned counsel appearing on behalf of the Accountant General.

2. Learned counsel appearing on behalf of the petitioner submits that petitioner has already filed

Patna High Court CWJC No.9632 of 2023 dt.04-09-2023 2/3 representation before the Deputy Secretary, Building Construction Department, Government of Bihar on 04.05.2023 and same has not been considered by him for payment of retiral dues to the petitioner. Learned counsel further submits that the representation of the petitioner may be disposed of in accordance with law within specified period.

3. Considering the aforesaid submissions made on behalf of the petitioner as well as the law laid down by the Hon'ble Apex Court in case of D.S. Nakara & Others Vs. Union of India reported in (1983) 1 SCC 305.

4. The Deputy Secretary, Building Construction Department, Government of Bihar, respondent no. 2 is directed to call for the service records relating to the petitioner from the office of Superintendent Engineer, Building Construction Department, Chapra, from where the petitioner had retired as well as from the other place of posting of the petitioner and take steps to make payment of retiral dues, payable to the petitioner, in accordance with law including sending a sanction letter to the Accountant General, Bihar for fixation of pension to the petitioner within a period of Six weeks from the date of passing of this order.

5. With the above observation and direction the writ petition stands disposed of.
