Petitioner is apprehending his arrest in a case registered for offences punishable under Sections 379 and 414 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that the petitioner is not named in the First Information Report nor there is any recovery from the possession of the petitioner and he has been falsely implicated in this case.
Heard learned A.P.P. also. He has pointed out that the charge-sheet has been submitted against the petitioner, showing him as an absconder.
On perusal of the record, it appears that the case is of the
Patna High Court Cr.Misc. No.48255 of 2016 (2) dt.16-12-2016 2/2 year 2006 and the petitioner has been continuously absconding from his whereabouts and the police have filed chargesheet declaring him to be an absconder. In view of the above, I am not inclined to grant the petitioner, the privilege of anticipatory bail. However, if the petitioner surrenders before the Court below, within a period of six weeks, he may be released on provisional bail for a period of three months and during the above period of three months, the petitioner will present himself on all material times and only after satisfying the conduct of the petitioner for three months, the provisional bail granted to the petitioner shall be confirmed by the Court below.
