The petitioner seeks bail in connection with Pusa P.S. Case No. 78 of 2017 dated 23.07.2017 instituted for the offences under Sections 387 and 506 of the Indian Penal Code. The informant was asked to pay up Rs. 20 lakhs as protection money and the caller threatened that in case the money is not paid, the informant would be done away with. Learned counsel for the petitioner has submitted that he is not named in the FIR and has only been falsely implicated in this case. There is no material against the petitioner of having used the mobile telephone through which the concerned call was made to the informant. It has further been submitted that because of the criminal antecedents of the petitioner, he was arrested on
Patna High Court Cr.Misc. No.51125 of 2017 (3) dt.07-12-2017 suspicion. Thereafter, it is alleged that he was made to sign on a blank piece of paper which was converted into his so called confession.
The petitioner is in custody since 12.08.2017. Taking into account the period of custody of the petitioner as also the fact that in the two cases which have been lodged against the petitioner earlier, he is on bail. In the facts and circumstances, the petitioner above named is directed to be released on bail on his furnishing bail bond in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VI, Samastipur in connection with Pusa P.S. Case No. 78 of 2017.
