The petitioner apprehends his arrest in connection with C2 No. 262 of 2016 registered under Section 47(a) of the Bihar Excise (Amendment) Act.

The accusation is that, in course of checking, one motorcycle bearing registration no. BR 30J 2248 was intercepted, which was driven by one Subodh Kumar Jha, keeping two gunny bags, containing Nepali liquor, who disclosed that Umesh Ram and Ganesh Ram deputed him to give both bags to the petitioner and one Mukesh Kumar of village Dostpur.

Patna High Court Cr.Misc. No.53675 of 2016 (2) dt.20-12-2016 Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. and nothing has been recovered from possession of this petitioner rather his name has been disclosed by one Subodh Kumar, who was apprehended by the police with motorcycle keeping two gunny bags, containing 50.540 litres of Nepali liquor. Further submission is that alleged recovered Nepali liquor is not belonging to this petitioner and he has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, connection with C2 No. 262 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
