ANJANA MISHRA ORAL ORDER 08-01-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending her arrest in connection with Baheri P.S. Case No.109 of 2015 for allegedly having committed the offence under Sections 302 and 201/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. and the entire allegation is against other co-accused. It is further submitted that the petitioner's name has surfaced subsequently on account of the confessional statement made before the police by a co-accused, which has got no evidentiary value in the eye of law. Considering the fact that the petitioner is lady and

No.57468 of 2015 (2) dt.08-01-2016 2/2 that there is no further material and also that she has been named merely on suspicion, let the petitioner, above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga, in connection with Baheri P.S. Case No.109 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
