JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-01-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 26.4.2017 passed in Cr.Misc.No. 18926 of 2017 with a direction to the trial court to expedite the trial and conclude the same within a period of six months. Submission of learned counsel for the petitioner is that up till now not a single witness has been examined in this case. Heard learned APP also.

From the report of the court below it appears that charge has been framed and trial court seeks one month time to conclude the trial as learned Special P.P. assured that all witnesses will be adduced their evidence within the said period.. In such view of the matter, I am not inclined to grant bail to the petitioner at this stage.

No.56806 of 2017 (3) dt.03-01-2018 2/2 However, learned trial court is directed to expedite the trial and conclude the same within a period of one and a half months and if not concluded, petitioner shall be released on bail by the trial court itself to its own satisfaction if there is no laches on the part of the petitioner in concluding the trial. At the same time, the petitioner is directed to co-operate in trial, otherwise the said direction has no effect.

With the above observation, this application is disposed of.
