JUSTICE ARUN KUMAR ORAL ORDER 20-12-2017 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Banmankhi P.S.Case No. 286 of 2017 registered under Sections 307, 323, 379, 461 and 511 of Indian penal Code and Section 27 of the Arms Act.
Allegation in brief is that some miscreants were making attempt to break open the lock of the cloth shop and the informant raised alarm upon which accused persons opened fire retreating back on a vehicle and the local people apprehended the petitioner after chase.
Learned counsel for the petitioner submits that the petitioner is a lady and there is no allegation regarding making any attempt of breaking lock of the shop rather she was passer-by and real culprit escaped away and on suspicion she was
Patna High Court Cr.Misc. No.60948 of 2017 (2) dt.20-12-2017 2/2 apprehended by the local people and she is in custody since 15.11.2017 having no criminal antecedent.
Having considered the aforesaid facts and circumstances, the petitioner, namely, Seema Devi @ Seema is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Banmankhi in connection with Banmankhi P.S. Case No. 286 of 2017.
