Mr. Ajay Kumar Jha ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 22-03-2022 Heard learned counsel for the petitioners and the learned APP for the State.

The petitioners seek bail in connection with Belsand P. S. Case No.19 of 2019, instituted for the offences under Sections 387 of the Indian Penal Code.

The learned counsel for the petitioners submits that the petitioners are in custody since 28.09.2020, charge-sheet has been submitted in the case and petitioner no.1 has antecedent of five cases and petitioner no.2 has antecedent of three cases. The learned counsel for the petitioners submits that the informant, who owns a petrol pump alleges that he received a call on his mobile from Mobile No.9117909833 and the caller demanded extortion of Rs. Five lacs and threatened if extortion amount was not made, he would be killed.

The learned counsel for the petitioners submits that

Patna High Court CR. MISC. No.53593 of 2021(4) dt.22-03-2022 2/2 admittedly, from the allegation, it would manifest that there was only a call for extortion, but the amount of extortion was not made. The learned counsel further submits that the mobile does not belong to the petitioners and since the petitioners have antecedents, as such, they came to be implicated. Learned A.P.P. opposes the bail application.

Considering the fact submits that the petitioners are in custody, charge-sheet has been submitted in the case in the nature of allegation as alleged, the petitioners, above-named, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of Sri Jyoti Prakash, learned Additional Chief Judicial Magistrate-1st, Sitamarhi in connection with Sessions Trial No.103 of 2020 arising out of Belsand P. S. Case No.19 of 2019, subject to condition that one of the bailors of the petitioners shall be their father namely, Chandraket Singh.

The application stands allowed.
