JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 13-03-2019 Supplementary affidavit has been filed on behalf of the petitioner and copy has already been served to the State. Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with S.T. No. 231 of 2017, arising out of Bagain Gola P.S. Case No. 55 of 2016, registered under Sections 147, 148, 149, 341, 323, 307, 302, 379 and 504 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that there is general allegation against the petitioner and other accused named in the F.I.R. to cause injury to Bidyasagar Singh, father of the informant, through lathi, danda, fist and slaps, later on, he died on the spot. Further submission is that petitioner

Patna High Court CR. MISC. No.74519 of 2018(4) dt.13-03-2019 2/2 has no criminal antecedent and is in custody since 26.10.2016. Further submission is that while charge against the petitioner has been framed on 08.03.2018, but not a single witness has been examined up till now.

A report, as called for, regarding the present stage of trial, has been received from the Court of 1st Addl. Sessions Judge, Buxar vide Letter no. 10, dated 12.02.2019, which disclosed that charge has been framed on 08.03.2018 and out of 13 prosecution witnesses not a single witness has been examined.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 1st Additional Sessions Judge, Buxar in connection with S.T. No. 231 of 2017, arising out of Bagain Gola P.S. Case No. 55 of 2016.
