2. Petitioner is apprehending his arrest in a case registered for the offences punishable under sections 323, 341, 498A, 504, 506/34 of the Indian Penal Code and sections 3⁄4 of the D.P.Act.
3. Despite valid service of notice, the opposite party no. 2 has not appeared in the present proceeding.
4. This is a case under section 498A of the IPC. The petitioner is husband of the OP.No.2. The FIR has been filed by the OP.No. 2 which discloses allegations of demand of dowry and torture.

Learned counsel for the petitioner submits that the allegations made in the FIR are not correct and as a matter of fact, the petitioner had always been ready to bring the OP.No.2 back to the matrimonial house but he failed. Despite all his sincere efforts, the O.P.No.2 refused to come back to the matrimonial house. The O.P.No.2 has performed second marriage with one Roshan Kumar and the copy of a certificate to that effect written by the Surpanch of the said village has been annexed as Annexure-2 to the present petition. However, no charge sheet was submitted against other co-accused persons.
5. The learned counsel for the O.P.No. 2 opposes the prayer for anticipatory bail.
6. Considering all the above mentioned facts and circumstances, I am inclined to grant privilege of anticipatory bail to the petitioner. Accordingly, in the event of his arrest/ surrender within a period of four weeks from today the petitioner shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand)with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/ successor court in connection with Mohiuddinnhagar P. S. Case No. 270 of 2022 subject to condition as laid down under section 438(2) of the Cr.PC and
