Petitioner is apprehending his arrest in a case registered for offences punishable under Section 302 and 328/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that the petitioner is Nandoshi of the deceased and has no concern with the alleged offence. The petitioner has been named in the F.I.R. but after investigation, the investigating officer found the petitioner innocent and submitted final form, stating therein that the case found not true against the petitioner. It has further been submitted that other co-accused persons against, whom specific allegations had been made, have already been acquitted in Sessions Trial No.

Patna High Court Cr.Misc. No.49010 of 2016 (2) dt.16-12-2016 2/2 219 of 2015 and Sessions Trial No. 354 of 2016. The petitioner is a man of clean antecedent.

Considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within a period six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M-1st.., Banka, in connection with Dhoriya P.S. Case No. 184 of 2012, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sunil/- U
