The petitioner seeks bail in Rajnagar P.S. Case No. 242 of 2016 registered under Section 394 of the Indian Penal Code.
Two unknown miscreants are said to have committed robbery in the house of the informant and two other persons and looted away ornaments and mobile phone, etc. It is submitted by learned counsel for the petitioner that the petitioner is not named in the F.I.R. He has been falsely implicated in the case merely on the confessional statement of the co-accused Manoj Mandal who was arrested with the looted mobile and said Manoj Mandal has been enlarged on bail by the
Patna High Court Cr.Misc. No.53825 of 2017 (4) dt.13-12-2017 2/2 learned lower court. Though some articles are said to have been seized from the possession of the petitioner, but the said articles were not put on T.I.P. and same are easily available in the market and the same are hailing to him. The petitioner has been languishing in custody since 22.08.2017.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-I, Madhubani in connection with Rajnagar P.S. Case No. 242 of 2016.
