====================================================== CORAM: HONOURABLE MR. JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 02-03-2016 The application seeks recall of the order dated 07.10.2015 and thereby restore C.W.J.C. No. 13552 of 2012 to its original file and number.
The order dated 7.10.2015 reads as under:- "On call, no one has appeared on behalf of the petitioner. Counsel for the respondents is present. The writ petition was dismissed earlier for want of prosecution. Subsequently, it has been restored. Since no one has appeared to press this application, the same is dismissed for non-prosecution." On going through the pleadings made in the application, I do not find it a fit case where indulgence can be granted. The application is dismissed. Needless to observe that if the
Patna High Court MJC No.331 of 2016 (2) dt.02-03-2016 2/2 cause survives, the petitioner shall be at liberty to file a fresh application.
