JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-12-2015 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 379, 353, 504 of the Indian Penal Code.
The prosecution case is of making assault to the informant and Ramashish Paswan by twenty F.I.R named accused persons including the petitioners and 10-15 unknown. It is further alleged that co-accused Bhupat Manjhi @ Bipat Manjhi snatched gold chain from Ramashish Paswan and coaccused Dinesh Manjhi took out Rs. 1000/- from the pocket of
Patna High Court Cr.Misc. No.57239 of 2015 (2) dt.18-12-2015 2/2 the informant.
It is submitted by learned counsel for the petitioners that two persons received injuries from the informant's side and one injury has been found to be grievous, whereas there is counter version of the occurrence and three persons from the petitioners' side received injuries. Moreover the accusation of assault is not specific against the petitioners. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, IV, Nawada in connection with Kawakole(Rupau) P.S. Case No. 100 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
