JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 08-04-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Complaint Case No. 247 of 2015 for the offences punishable under sections 498 A and 323/34 of the I.P.C and section 4 of the Dowry Prohibition Act. On behalf of the petitioner it is submitted that the opposite party no.2 inspite of notice has not appeared as the matter has been compromised and she is living separately after taking all her belongings. In the supplementary affidavit copy of the compromise petition has also been filed which is Annexure-2 and as such in view of compromise arrived at between the parties the petitioner deserves sympathetic consideration.

after going through the compromise petition fairly submits that the complainant and the accused persons have compromised the case.

In view of compromise arrived at between the parties, the petitioner, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. S.D.J.M. Bikramganj, Rohtas in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
