JUSTICE ASHUTOSH KUMAR ORAL ORDER 15-01-2019 The petitioner seeks bail in anticipation of his arrest in connection with Excise Case No. 385 of 2018, arising out of Chousa P.S. Case No. 269 of 2017 dated 21.09.2017 instituted for the offences under Sections 30(a), 37(b) of the Bihar Prohibition & Excise Act, 2016. The house of one Binod Yadav @ Dahu Yadav was raided from where 70.4 litres of liquor is said to have been recovered.

The learned counsel for the petitioner has submitted that name of the petitioner has transpired in the statement of one Birbal Sah, who at the time of making his confession was in the state of inebriation.

No.73163 of 2018(3) dt.15-01-2019 2/2 Since there is no recovery from the petitioner and that he was not apprehended from the spot and his having clean antecedents, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/- (ten thousands) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-II, Special Judge, Excise Act, Muzaffarpur in connection with Chousa P.S. Case No. 269 of 2017, G.R. No. 1164 of 2017, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
