Mr.Sanjay Kumar, APP ====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL ORDER 25-01-2024 The present application has come on board under the heading "To Be Mentioned", at the instance of the learned counsel for the petitioner for certain modification in the order passed on 19.01.2024.
2. Learned counsel for the petitioner submits that already charge-sheet has been filed and cognizance has been taken by the Court.
3. In such circumstances, order dated 19.01.2024 is modified with the following directions:- (i) The petitioner, if not already appeared before the court, shall appear before the court, within a period of four weeks;

No.44522 of 2023(5) dt.25-01-2024 2/2 (ii) On appearance, the accused/ petitioner shall be released on personal recognizance bond by court on the same day, in accordance with the directions issued by the Hon'ble Supreme Court in Md. Asfak Alam v. The State of Jharkhand & Anr.
[Criminal Appeal No. 2207 of 2023, arising out of Special Leave Petition (Crl.) No. 3433 of 2023, disposed of on 31.07.2023];
(iii) The accused/petitioner shall ensure appearance of himself or his Advocate on all the posting dates and co-operate with the trial; (iv) On continued absence of accused/petitioner, the concerned court would be entitled to take appropriate proceedings to ensure his appearance, as provided under the Code of Criminal Procedure.
