Heard the learned counsel for the petitioner through video conferencing. None appeared on behalf of the informant. The petitioner apprehends his arrest in connection with Revilganj P.S. Case No. 270 of 2019 registered for offence punishable under section 498(A) of the Indian Penal Code. Office note shows that the notice was issued to the informant. The notice was received by Ashok Manjhi, the father of the informant, Lalita Devi.

By drawing my attention towards paragraph 3 of the

Patna High Court CR. MISC. No.1456 of 2021(5) dt.04-03-2022 2/2 case diary, which shows the statement of Ashok Manjhi, the father of informant, the learned counsel for the petitioner has submitted that the informant's father himself has stated that the marriage of the informant was solemnized with one Niraj Kumar, as such, the informant is not legally wedded wife of the present petitioner.

Considering the above mentioned facts and circumstances, let the petitioner above named, in the event of his arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned 3rd Additional Sessions Judge, Saran at Chapra in connection with Revilganj P.S. Case No. 270 of 2019, subject to condition as laid down under section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
