JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 02-12-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 307 and some other allied of the Indian Penal Code.

As per the prosecution case, this petitioner along with co-accused, Arvind Kumar, assaulted son of informant with iron rod as a result of which he sustained severe injuries. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. No such occurrence took place as alleged in the FIR. There is case and counter case for the same occurrence and brother of petitioner lodged the case on 09.03.2020 but present informant lodged the case on 16.03.2020 for the same occurrence dated

Patna High Court CR. MISC. No.53435 of 2021(2) dt.02-12-2021 2/2 09.03.2020 without any explanation. Petitioner claims clean antecedent and is in custody since 01.06.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Arwal in connection with Arwal PS case No.98/2020.
