Chaudhary, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-11-2017 Heard the learned Senior counsel, namely, Mr. Bzxi S.R.P. Sinha, assisted by Mr. Lokesh Kumar Singh, Advocate. The petitioner seeks regular bail in connection with Kuchaikote P.S. Case No. 202 of 2017 for the offences punishable under Section 392 of the Indian Penal Code.

The case of the informant is that while he was coming along with his sister and mother, they were stopped at about 12 in the night by three persons who were coming on motorcycle and then they pushed the motorcycle resulting in the informant's mother and sister falling down whereafter one accused assaulted by knife and others took away the motorcycle.

The learned Senior counsel submits that the petitioner has only one case against him under the Excise Act and he is on bail in the said case. It is further submitted that the FIR is against unknown person and the petitioner has been roped in the present case only on confessional statement of a co-

In the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail immediately upon completion of six months of his custody i.e. from 04.08.2017, on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- VII, Gopalganj in connection with Kuchaikote P.S. Case No. 202 of 2017 and also subject to other terms and conditions as may be deemed fit and proper by the learned trial court.
