Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks regular bail in connection with Bihpur P.S. Case No.276 of 2023 dated 08.05.2023 registered for the offence/s punishable under Section/s 323, 504 and 506 of the Indian Penal Code and Section/s 25(1-b)a of the Arms Act.

The main submissions advanced by the learned counsel for the petitioner are that though against the petitioner there are criminal antecedents of four cases but the said cases were lodged by the informant's side, the petitioner is cousin brother of the informant, in between them a land dispute is running, so far as the recovery of fire-arm is concerned, the

No.46865 of 2023(3) dt.03-08-2023 2/2 same was produced by the informant himself to the police and the main allegation against this petitioner is of demanding his share in the disputed land and also giving threat to the prosecution party. Further submissions are that the petitioner has been languishing in jail since 09.05.2023 and against him the investigation has been completed.

Learned APP appearing for the State opposes the bail prayer.

Considering the above submissions and the nature of allegation appearing against this petitioner and also the completion of investigation against him, in my opinion it is a fit case for bail to the petitioner. Accordingly, let the petitioner named-above be released on bail in connection with Bihpur P.S. Case No.276 of 2023 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
