The petitioner apprehends his arrest in Jagdishpur (Goradih) P.S. Case No.113 of 2019 registered under Sections 307, 379, 354B and other sections of the Indian Penal Code. The informant and his wife had gone to the house of their daughter. It is alleged that Session Paswan, Kunal Paswan and Amrit Paswan (petitioner) came and began to abuse the informant and his wife. The petitioner is alleged to have assaulted the informant with leg on his chest. Learned counsel for the petitioner submits that from perusal of Annexure 2, it would appear that the informant did not receive any external or internal injury. The informant and his wife had gone to the house of their daughter for settlement of the dispute where some altercation took place but no assault was

Having considered the facts and the nature of allegation made against the petitioner and the fact that no external or internal injury was found on the person of the informant, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhagalpur in connection with Jagdishpur (Goradih) P.S. Case No.113 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
