====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 18-01-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Lakhisarai (Kabaiya) P.S. Case No. 468 of 2016 registered under Sections 341, 323, 307, 504, 498(A), 506/120(B) of the Indian Penal Code and 3⁄4 of the Dowry Prohibition Act. The allegation is of cruelty and torture by the petitioner and her in-laws' family members due to non-fulfillment of demand of dowry.
Learned counsel appearing on behalf of the petitioners submits that petitioners, who happen to be father-inlaw and Debar of the informant, have falsely been implicated in
Patna High Court Cr.Misc. No.49882 of 2016 (3) dt.18-01-2017 2/2 this case. Further submission is that co-accused persons namely, Geeta Singh @ Geeta Prasad and Parviti Devi have already been allowed bail by a Bench of this Court vide Cr. Misc. No. 43470 of 2016.
Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the C.J.M., Lakhisarai in Lakhisarai (Kabaiya) P.S. Case No. 468 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Arvind Srivastava, J) Shail/- U T
