The present application has been filed for modification of the order dated 30.11.2015 passed in Cr.Misc.No. 43161 of 2015, by which the petitioner was granted provisional bail for a period of three months in connection with Araria P.S. case No.691 of 2014, pending in the court of Chief Judicial Magistrate, Araria and he was directed to deposit the balance amount of Rs.31,000/- in the court below within a period of three months from the date of release.

It is submitted on behalf of the petitioner that due to some unavoidable reasons the petitioner could not deposit the balance amount in the court below well within time. It is prayed on behalf of the learned counsel for the petitioner that further time

Patna High Court Cr.Misc. No.53939 of 2017(2) dt.06-12-2017 2/2 may be extended so that the petitioner can deposit the balance amount in the court below.

Considering the submissions made on behalf of the learned counsel for the petitioner and the grounds mentioned in the modification application, four weeks time is granted to the petitioner for depositing the balance amount of Rs.31,000/- in the court below. The rest of the conditions stipulated in the order will be same.

The order dated 30.11.2015 passed in Cr.Misc.No. 43161 of 2015, is modified to the extent as indicated above. The modification application is, accordingly, disposed of. Let this order be communicated to the learned court below through e-mail.
