The petitioner seeks bail in a case registered for the offence under Sections 30(a), 36, 41(1) of Bihar Prohibition and Excise Act.
As per the prosecution case, 5527 liters of illicit foreign liquor has been recovered from a truck and local chowkidar identified this petitioner and other co-accused, who fled away from the place of recovery.
It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of this petitioner. Petitioner is neither owner nor driver of the said truck and is in custody since 13.07.2021.
However, learned A.P.P. for the State has opposed the
Patna High Court CR. MISC. No.55560 of 2021(3) dt.29-01-2022 2/2 bail petition and submitted that petitioner has got criminal antecedent and he is accused in seven more cases, mostly of similar nature.
Considering the aforesaid facts & circumstances and the fact that petitioner has got criminal antecedent of similar nature of cases, the learned court below, where the case is pending, is directed to release the petitioner on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Paroo P.S. Case No. 78 of 2021, after framing of the charge. (Prabhat Kumar Singh, J) anay/- U T
