The petitioner apprehends his arrest in connection with Barh P.S. Case no. 272 of 2015, registered under Sections 307, 324 & 326/34 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that it would appear from the F.I.R. that the informant reached near his injured brother Sanjay Kumar @ Gayemata after hearing the sound of firing then he disclosed the name of seven persons named in the F.I.R. and some others, who had shot at him and thereafter brother of the informant become unconscious and he was rushed to the Sadar Hospital, Barh from where he was referred to PMCH, but he admitted his brother in Rajeshwar Hospital, Patna, where his treatment is going on. Except the suspicion raised by the informant, there is nothing against the petitioner to show his involvement in the present case. Further submission is that while petitioner is accused in three other cased, but he is on bail in that cases.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Barh, District-Patna in connection with Barh P.S. Case No. 272 of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
