JUSTICE MOHIT KUMAR SHAH ORAL ORDER 01-05-2023 The present writ petition has been filed seeking the following relief:- "1.That, this is an application for issuance of an appropriate writ, order or direction for setting aside the order as contained in Memo No. 638 dated 03.06.2022 issued under the signature of the Circle Officer, Atri (Gaya) whereby and whereunder he cancelled the Residence Certificate of the petitioner bearing Certificate No. BRCCO/2022/4990287 dated 01.04.2022 as well as for directing the respondent authority to revive the said

Patna High Court CWJC No.11523 of 2022(2) dt.01-05-2023 2/2 certificate."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to challenge the aforesaid order dated 03.06.2022, passed by the Circle Office, Atri, District-Gaya, by filing appropriate appeal/representation before the District Magistrate, Gaya. Liberty so sought is granted. It is needless to state that in case the petitioner approaches the District Magistrate, Gaya, by filing appropriate appeal/representation within a period of four weeks from today, the District Magistrate, Gaya, shall consider the same on merits and pass a reasoned and a speaking order, in accordance with law, within a period of eight weeks, thereafter. The writ petition stands disposed off as not pressed.
