The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 363 and 366A/34 of the Indian Penal Code.

The accusation is of kidnapping the 13 years old daughter of the informant. It is alleged that one Md. Arif, who is tutor of the victim and his friends namely Arun Kumar Poddar, Nitish Kumar and Vishal Kumar had gone on a school tour programme and from where the victim went traceless. The victim has not been traced till now.

It is submitted by learned counsel for the petitioners that though there was a complaint against Md. Arif from before but except that there is nothing specific against these petitioners

Patna High Court Cr.Misc. No.57030 of 2015 (2) dt.17-12-2015 2/2 and the petitioners have been roped in the present case simply because they are mother and sister of Md. Arif. Moreover, the thrust of accusation is against Md. Arif.

Considering the thrust of accusation against Md. Arif and the petitioners being lady, let them be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Begusarai in connection with Ballia P.S.

Case No.303/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
