JUSTICE RAKESH KUMAR ORAL ORDER 23-12-2016 Heard Sri Manish Chandra Gandhi, learned counsel for the petitioner and Sri Matloob Rab, learned Additional Public Prosecutor.

The petitioner, husband of the daughter of the informant, apprehending his arrest in Hajipur Town P.S. Case No. 325 of 2014 registered for the offence under Section 498(A), 328/ 34 of the Indian Penal Code, has prayed for grant of bail in the event of his arrest or surrender.

Patna High Court Cr.Misc. No.48997 of 2016 (5) dt.23-12-2016 2/2 In this case , earlier case diary was called for , which has been received. Sri Rab, learned Additional Public Prosecutor by way of referring to the statement made in paragraph no. 14 of the case diary as well as other materials submits that there is sufficient material against the petitioner. Accordingly, the Court is of the opinion that it cannot be a case for extending the privilege of anticipatory bail. However , if within a period of six weeks from today petitioner appears before the court below and makes a prayer for regular bail, the learned court below without being prejudiced with this order may examine the same and pass appropriate order in accordance with law preferably on the same day.

The petition stands dismissed.
