The Petitioner seeks bail in Jakkanpur P.S. Case No. 172 of 2017 registered for the offence punishable under Sections 379/34 of the Indian Penal Code.

Allegation against the petitioner is of committing theft.

Informant is the driver of the vehicle and he used to park the vehicle after driving the vehicle in front of his house in Parvati Complex. When he woke up in the morning, he found the said vehicle missing from that place and thereafter he informed the owner of the vehicle. The FIR is against unknown. The name of the petitioner has surfaced only on the basis of confessional statement of co-accused Sohrab Alam. The vehicle

Patna High Court Cr.Misc. No.57975 of 2017(3) dt.11-01-2018 2/2 has been recovered from the other co-accused and nothing incriminating has been recovered from the possession of the petitioner. It has been further submitted that similarly situated co-accused persons have been granted bail by a co-ordinate bench of this Court vide orders dated 09.11.2017 in Criminal Miscellaneous No. 52592 of 2017 and 14.11.2017 in Criminal Miscellaneous No. 52647 of 2017. The petitioner is in custody since, 05.08.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub- Judge-1 cum A.C.J.M., Patna in connection with Jakkanpur P.S. Case No. 172 of 2017.
