====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 12-07-2019 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Buxar (Town) P.S. Case No. 720 of 2018, instituted for the offence under Section(s) 341, 323, 498(A), 376 and 379/34 of Indian Penal Code.

Counsel for the petitioner submits that the instant case is counter blast of earlier case filed by petitioner against the informant vide Complaint Case No. 658 of 2018. Xerox copy of the aforesaid Complaint Case has been enclosed as Annexure-3. In the instant case the informant has alleged that petitioner has performed marriage with her in Mandir in Lucknow. After marriage he started misbehaving and assaulted her. It is further

Patna High Court CR. MISC. No.42274 of 2019(2) dt.12-07-2019 2/2 alleged that petitioner by making fraud has established physical relationship with her by deceitful means. He kept her in Patna and Lucknow. Later on, the informant learnt that petitioner is already married.

Counsel for the petitioner submits that the entire allegation against the petitioner is to put pressure on him as he has purchased land in Lucknow. The informant is also resident of Lucknow.

Petitioner is in custody since 27.5.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar, in connection with Buxar (Town) P.S. Case No. 720 of 2018, subject to the condition that both the bailors will be close relatives of the petitioner.
