1. Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel appearing on behalf of the informant.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 118(2), 109 and 3(5) of the BNS.

3. Learned counsel appearing on behalf of the petitioner submits that the informant alleges that the petitioner on 25.04.2025, at around 08:00 p.m., assaulted him along with 5-6 co-accused persons outside the hospital on account of which the informant sustained injuries on his head and right eye.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is further submitted that petitioner is nursing staff in the same hospital and informant is RMO of the said hospital. It is

Patna High Court CR. MISC. No.42179 of 2025(2) dt.09-07-2025 2/2 next submitted that informant being superior officer of the petitioner used to misbehave with him for which the petitioner and others had also filed complains against him.

5. Learned A.P.P. for the State and the learned counsel appearing on behalf of the informant opposed the prayer for anticipatory bail of the petitioner. Learned counsel appearing on behalf of the informant submits that petitioner being subordinate assaulted his superior. It is further submitted that if petitioner was aggrieved by the act of the informant in that event he could have complained to the management. It is next submitted that informant suffered injuries on his head and eye on account of which he was admitted in the ICU.

Considering the submissions made by the learned counsel appearing on behalf of the informant, the Court is not inclined to extend the privilege of anticipatory bail to the petitioner in connection with Kankarbagh P.S. Case No. 363 of 2025 pending in the Court of learned ACJM-XI-cum-CJ (SD) XI, Patna/Successor Court.
