JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 15-12-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Marhawrah P.S. Case No. 324 of 2016 for the offences punishable under sections 341, 323, 324, 504, 307 and 379/34 of the I.P.C.

Allegedly, when the informant was sowing seeds of Masuri in his land then the petitioner and other co-accused came and started abusing and thereafter the petitioner assaulted the informant with Farsa on his head and when the wife came for rescue she was also assaulted by Lathi and Danda and further her gold chain was snatched by Rohit Kumar Singh. Submission is of false implication and that no such

No.47566 of 2016 (2) dt.15-12-2016 2/2 occurrence has taken place, the informant after self inflicting injury has lodged this case, the injury found on the person of the informant is superficial in nature which is simple, vide Annexure2, and as such the petitioner deserves sympathetic consideration as the occurrence has taken place due to the land dispute. The learned A.P.P. after going through Annexure-2 fairly submits that the injury, which is superficial in nature was caused to the informant.

In the facts and circumstances as stated above, the petitioner, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. A.C.J.M-II, Saran at Chapra in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
