JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420/34 of the Indian Penal Code and Section 7 of the Essential Commodities Act. 440 litres of coloured kerosene oil were recovered from the petitioner.

It is submitted by learned counsel for the petitioner that recovery has been made from the joint family house and even assuming the accusation, no offence is made out under Sections 420/34 of the IPC.

The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six

Patna High Court Cr.Misc. No.56494 of 2015 (2) dt.14-12-2015 2/2 weeks in connection with Rampur P.S. Case No. 232 of 2015 pending in the court of learned CJM, Gaya.
