The petitioner apprehends his arrest in Kotwali P.S. Case No.162 of 2019 registered under Section 366 of the Indian Penal Code.

The informant disclosed that his daughter had gone outside her house to purchase vegetables but she did not return home. During course of search, the informant came to know that the petitioner kidnapped his daughter for the purpose of marriage.

Learned counsel for the petitioner submits that the victim is a major girl. The victim made her statement under Section 164 of the Cr.P.C. She disclosed that she was on talking term with the petitioner for last 2-3 years. She further disclosed that the petitioner enticed her for the purpose of marriage but

Having considered the facts aforesaid and the fact that the victim appears to have left her house and accompanied the petitioner but later on she complained that the petitioner did not marry with her, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gaya in connection with Kotwali P.S. Case No.162 of 2019, subject to the conditions as laid down under Section 438

(2) of the Code of Criminal Procedure.
