JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 17.01.2018 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor.

On getting confidential information regarding presence of anti-social elements over the roof of double storey school building, raid was conducted and during course thereof, six miscreants were apprehended while remaining managed to escape, petitioners are amongst the same. It is further evident that from the possession of both the petitioners, countrymade loaded pistol have been recovered. Petitioner No.1, Manish Kumar has got no criminal antecedent and is under custody since 26.04.2017. On account thereof, petitioner no.1, Manish Kumar is directed to be released on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.60094 of 2017 (03) dt.17-01-2018 Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur in connection with Warisnagar P. S. Case No.97 of 2017.

So far petitioner no.2, Md. Chand is concerned, as per Para-3 of the petition, he has got criminal antecedent and on account thereof, for the present, prayer for bail of petitioner no.2 is rejected.
