The petitioner is apprehending his arrest in connection with Aurai P.S.Case No.32 of 2019 dated 9.2.2019 , registered for offences punishable under Sections 376 of the Indian Penal Code and Sections 4/6 of POCSO ACt.

Allegation against the petitioner is of committing rape of the daughter of the informant, who is minor.

Submission of the learned counsel for the petitioner is that the whole allegation does not appear to be probable as the occurrence took place inside the school and the mother of the victim was also working there as Aangan Bari Sevika and there is delay of 5 days in lodging the FIR.

Heard learned A.P.P., who has opposed the prayer for bail

Patna High Court CR. MISC. No.42343 of 2019(2) dt.09-07-2019 2/2 on the ground that there is direct allegation against the petitioner and the victim is minor. .

Having heard both sides and in view of the facts and circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioner. Accordingly, this application is dismissed.

With the aforesaid direction, this application is dismissed.
