1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The learned counsel for the petitioners, after arguing vehemently for some times realizing his difficulty, seeks permission to withdraw the anticipatory bail application with respect to petitioner nos. 1 (Mahesh Paswan @ Mahesh Ram), 2 (Naresh Paswan @ Suraj Kumar Paswan) and 3 (Awadesh Paswan @ Awadesh Kumar) respectively with liberty to the petitioners to surrender and seek regular bail.

3. Permission is accorded.

4. The petitioner no. 4 apprehends her arrest in a case

Patna High Court CR. MISC. No.44359 of 2026(2) dt.21-07-2026 2/3 registered for the offences punishable under Sections 190, 191(2), 126(2), 115(2) and 109 of the BNS read with Section 4 and 6 of the POCSO Act.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is a woman and the informant alleges that on 25.01.2026 at about 07:00 PM, his grandson aged about 7 years was playing outside the house at 06:00 PM when Bhagwan Paswan came and took him away and tried to commit wrong after opening his pant, but on alarm informant and his family members came at the place of occurrence and saw the victim on bed, further Bhagwan fled, but his family members came and Mahesh assaulted Mantu by an iron rod causing injury on head, thereafter, Naresh assaulted Pintu by dab causing injury on head while Awadhesh and petitioner no. 4 assaulted Upendra by lathi causing injury on head, thereafter, wife of Bhagwan and his three daughter-inlaws assaulted the informant causing injury on head and bled from ear.

6. Learned counsel for the petitioner submits that petitioner no. 4 has been falsely implicated in the instant case by the informant being related to Bhagwan. It is further submitted that even allegation of assault against petitioner no. 4 is not

Patna High Court CR. MISC. No.44359 of 2026(2) dt.21-07-2026 3/3 specific rather it is alleged that she along with Awadhesh assaulted Upendra by lathi causing injury on head. It is reiterated and submitted that petitioner is a person with clean antecedent and has been implicated only with an intent to coerce the male members of the family into submission.

7. Learned A.P.P. for the State opposes the anticipatory bail application of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner no. 4 only abovenamed, in the event of her arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Ara Muffasil P.S. Case No. 24 of 2026 subject to the conditions as laid down under Section 482 (2) of the BNSS.

9. Accordingly, the instant anticipatory bail application stands allowed.
