====================================================== CORAM: HONOURABLE MR. JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 15-07-2026 Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 115(2), 126(2), 127(2), 65(1), 75, 76, 62, 109(1), 351(2), 3(5) of B.N.S. and 3, 4, 6 of POCSO Act.

3. The case of the prosecution is that one Bikendra Kumar attempted to commit rape with minor daughter of the informant. When he was being chased by the informant and others, he hided himself in the house of Rambabu Sah and it is alleged that the petitioner, along with others, did not permit the informant and others to enter in the house of Rambabu Shah.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.47203 of 2026(2) dt.15-07-2026 2/2 connection with the present case. It is further submitted that main thrust of the allegation is against one Bikendra Kumar. The only allegation against the petitioner that he had stopped the informant and other from entering into the house of Rambabu Shah, where Bikendra Kumar had hidden himself. Moreover, the petitioner is languishing in judicial custody since 16.05.2026.

5. Learned APP appearing for the State has opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Raxaul P.S. Case No. 235 of 2026 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 7th District and Additional Sessions Judge cum Special Judge, POCSO Act, East Champaran, Motihari.
