Petitioners seek bail in connection with Telhara P.S. Case No. 78/2017 for offences punishable under Sections 307, 328/34 of the Indian Penal Code.

The prosecution case, as lodged by the informant, is that while her son Tinku Ram had gone to his sasural, both his wife (petitioner no. 1) and her mother (petitioner no. 2) had mixed poison in his food, on which he became seriously ill and had to undergone treatment in the Primary Health Centre.

No.55110 of 2017 (2) dt.04-12-2017 2/2 It has been submitted by the learned counsel for the petitioners that they are innocent, no such overt act was committed by them and the victim son has already filed a petition that no such occurrence occurred. He submits that, in fact, the informant does not want to keep his daughter-in-law (petitioner no. 1) at the matrimonial house, as such, a false case has been lodged against them. He further submits that the petitioners bear no criminal antecedent and are languishing in judicial custody since 19.08.2017.

However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioners, above named, be enlarged on bail on furnishing bail bonds of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Hilsa, Nalanda, in connection with Telhara P.S. Case No. 78/2017. (Nilu Agrawal, J) Rajesh/- U T
